Landlord applied for MCI rent hikes based on the installation of a new water tank. The DRA ruled against landlord because there was a building-wide service reduction order in effect when the DRA's order was issued. Landlord appealed, pointing out that the order didn't reduce rents, but only directed landlord to restore a service. The DHCR ruled for landlord. The prior order, which didn't reduce rents, wasn't a bar to collection of the MCI rent increases. And the new water tank qualified as a major capital improvement.
