Landlord applied for MCI rent hikes based on the installation of a new roof coating over the existing roof. The DRA ruled against landlord. Landlord appealed, pointing out that the single-ply roof installation consisted of new technology materials containing rubber. The DHCR ruled for landlord. According to DHCR Policy Statement 91-2, this type of roof qualified as an MCI.
