Landlord applied for MCI rent hikes based on the installation of a new boiler. The DRA ruled for landlord. Tenants appealed, claiming that the new boiler wasn't needed because their steam pipe heat was adequate. The DHCR ruled against tenants. Providing heat on a building-wide basis constitutes an MCI. The fact that heat previously was provided in a different manner doesn't bar landlord from changing the heating system by installing a new boiler.
