Mitchell-Lama Building Not Subject to Rent Stabilization

Tenant complained to the DHCR of a reduction in building-wide services. The DRA ruled for tenant and reduced his rent. Landlord appealed and won. Landlord correctly argued that the building was a Mitchell-Lama housing project and therefore exempt from rent stabilization. The DHCR had no authority to hear tenant's complaint, and the DRA's order was revoked.
