MCI Rent Increase Granted for New Garage Roof

Landlord applied to the DHCR for MCI rent hikes based on installation of a garage roof. The DRA ruled for landlord. Tenant appealed and lost. Tenant argued that tenants who didn't own cars and don't use the garage weren't receiving any benefit from the new garage roof. But it has been long-standing DHCR policy that the installation of a new roof over a garage that is attached to the residential part of a building and used by tenants living in the building constitutes a building-wide improvement for which MCI rent increases may be granted.
