MCI Rent Hike Granted for Courtyard Resurfacing

Landlord applied for MCI rent hikes based on front courtyard resurfacing. The DRA ruled against landlord, stating that no increase was permitted for sidewalk replacement. Landlord appealed and won. The DRA incorrectly listed the work as sidewalk replacement. Landlord's application and diagram clearly showed that landlord replaced concrete areas within the property line. The work qualified as an MCI.
