MCI Increase Granted for Fire Alarm System

Landlord applied for MCI rent hikes based on the installation of a new roof, waterproofing, fire alarm system, engineering services, and roof inspection. The DRA ruled against landlord, who appealed and won in part. The DRA had denied the MCI increase based on a rent reduction order that was in place when landlord's application was filed. Although it was a building-wide rent reduction order, it involved a leak above one garage space only. The rent also had now been restored.

The DHCR granted the MCI rent increases for some items but delayed the effective date to the first rent payment date after the rents were restored. The DHCR disallowed any increase for terrace installation and waterproofing because not all terraces were replaced and landlord didn't show that all necessary pointing was performed.
