Landlord sued to evict loft tenant for nonpayment of rent. Landlord claimed that the loft was unregulated. Tenant claimed that the loft was rent stabilized and asked the court to dismiss the case. The court ruled against tenant. Tenant's lease started Aug. 1, 2001. Landlord previously had purchased tenant's rights. This deregulated the loft under Multiple Dwelling Law Section 286(12). The Loft Board also had made this ruling in 1999 after landlord filed an MDL Section 286(12) sale record.
