Laundry Room Not Commercial Space

Tenant challenged landlord's 1997 fuel cost report. The DRA ruled against tenant and found that landlord wasn't collecting more than the maximum allowable fuel cost adjustment. Tenant appealed, again claiming that landlord didn't include a commercial room count for a Laundromat operated in the building. The DHCR ruled against tenant. The laundry room that landlord provided to tenants with washers and dryers for tenants' convenience wasn't considered commercial space for fuel cost purposes under DHCR policy.

Tenant appealed, again claiming that landlord didn't include a commercial room count for a Laundromat operated in the building. The DHCR ruled against tenant. The laundry room that landlord provided to tenants with washers and dryers for tenants' convenience wasn't considered commercial space for fuel cost purposes under DHCR policy. And even if the laundry room was considered commercial space, it was only one room and would result in only a minor change to the fuel cost per room for the 190-room building.
