Landlord's Delay in Getting DOB Sign-Off Was Reasonable

Landlord applied for MCI rent hikes based on a new boiler installation. The DRA ruled against landlord because government sign-offs weren't submitted within two years of completion of the work. Landlord appealed and won. Landlord had requested a 30-day extension from the DRA on Dec. 11, 2006, to submit the electrical certificate from DOB. The DRA ruled against landlord during that 30-day period. By the time landlord filed its PAR, it was able to submit the DOB certificate of completion of the electrical work dated Jan. 17, 2007.
