Landlord's Agents Authorized Tenant's Electrical Alterations

LVT Number: #24000

Landlord sued to evict tenant for making unauthorized alterations in his apartment, in violation of tenant's lease. The court ruled against landlord, who appealed and lost. Landlord couldn't enforce the "no alterations" lease provision because tenant showed that landlord's authorized agents expressly consented to the electrical work landlord now complained about. Landlord also falsely stated in a prior DHCR proceeding that its own contractor had done the work in question.
