Landlord Submitted Usable Comparability Data

Tenant filed a fair market rent appeal. The DRA ruled for tenant and reduced his initial legal regulated rent. Landlord appealed, claiming that the DRA had rejected the comparability data landlord submitted for three apartments. The DHCR ruled for landlord in part. The DRA had requested proof of service of the DC-1 form for these three apartments. Landlord submitted none. But landlord was only required to submit a DC-1 for one of the three apartments. The other two were decontrolled during a period when when DC-1 or DC-2 notices weren't required upon decontrol.
