Landlord Started Repair Work

Landlord sued to evict tenant for nonpayment of rent. Tenant claimed breach of the warranty of habitability. Landlord showed that it had started repair work. But, tenant had refused access on a number of occasions, causing delay and preventing completion of any needed repairs. The court ruled for landlord. The court gave tenant a $1,000 abatement on the $8,000 in back rent owed.
