Landlord Re-Striped Parking Lot

Tenant complained of a reduction in building-wide services because landlord had re-striped the parking lot and moved the handicapped parking spaces. The DRA found that this violated the Americans with Disabilities Act (''ADA''), and ordered landlord to move the handicapped spaces close to the building entrance. Landlord appealed and won. The DHCR has no authority to rule on issues that may arise under the ADA. Landlord's re-striping wasn't a reduction in services. The DRA's order was revoked.
