Landlord Proved Individual Apartment Improvements Were Done

Rent-stabilized tenant complained of rent overcharge. The DRA ruled against tenant, finding no rent overcharge. Tenant appealed and lost. Landlord submitted proof in the form of invoices and cancelled checks to the DRA of individual apartment improvements (IAIs) costing $20,459. Tenant’s initial legal rent based on the vacancy increase and 1/40th increase for IAIs was $1,709, and landlord charged tenant a preferential rent of $1,550. Tenant’s claim that the work wasn’t done wasn’t supported by evidence.
