Landlord Proved Cost of Individual Apartment Improvements

Rent-stabilized tenant complained of rent overcharge. Her initial monthly rent in June 2015 was $1,500. The prior tenant's last rent was $753. The DRA ruled for tenant but found an overcharge totalling only $66.68. Tenant appealed and lost. Tenant questioned some of the individual apartment improvement (IAI) rent increases granted by the DRA. Tenant claimed, for example, that apartment windows were old and defective. But photographs tenant submitted didn't prove the age of the windows shown. Tenant also pointed out that she paid for a new refrigerator and kitchen sink.
