Landlord Promptly Corrected Condition

The DOB issued a violation for landlord's failure to maintain the building. The violation stated that the marble facade over the building's garage entrance was broken, loose, and falling. Landlord argued that two days before the violation was issued, he had discovered loose marble slabs over the garage entrance. He immediately had them taken down and roped off the area to prevent anyone from passing beneath. Landlord was in the process of finding a contractor to repair the condition when the violation was issued. The ALJ dismissed the charge, and the DOB appealed.
