Landlord Promised to Pay for Improvements

The DRA granted landlord's application for MCI rent hikes. Tenants appealed, pointing out that landlord had agreed to pay for the MCIs in its cooperative conversion offering plan for the building. The DHCR revoked the MCI rent increases, and landlord appealed. An appeals court found that the DHCR's decision was reasonable. Landlord, as the cooperative sponsor, agreed to install windows at its sole cost and expense and to upgrade the electricity in tenants' apartments.
