Landlord Needn't Replace ‘Lot Line' Windows to Qualify

Landlord applied for MCI rent hikes based on installation of new windows. The DRA ruled for landlord, granting rent increases for most apartments. But the DRA ruled that landlord must replace ''lot line'' windows in ground floor apartments before getting any rent increase from these tenants. Landlord appealed and won. Under DHCR Policy Statement 89-6, landlord need only replace regular apartment windows. Hallway or lot line windows require protective wired glass and needn't be included as part of the MCI work as long as other apartment windows are replaced.
