Landlord Needn't Plead Compliance with Multiple Dwelling Law

LVT Number: 15577

Landlord sued to evict loft tenant. Tenant asked the court to dismiss the case. Tenant claimed that landlord's petition was defective because it didn't state that landlord was in compliance with the registration requirements of the Multiple Dwelling Law. The court ruled against tenant. Tenant appealed and lost. Landlord claimed that tenant had an expired commercial lease and wasn't protected by the Loft Law. So landlord didn't have to plead compliance with the Multiple Dwelling Law registration requirements.
