Landlord Needn't Add Name to Renewal Lease

LVT Number: 14805

Tenant complained that landlord refused to add the name of apartment occupant to his rent-stabilized renewal lease. The DRA ruled for tenant and ordered landlord to add the occupant to the lease. Landlord appealed and won. Occupant wasn't a named tenant on the prior renewal lease. Although she signed that renewal lease unilaterally, landlord hadn't agreed to this. In addition, tenant paid rent from a bank account that was in his name only, so there was no proof that landlord accepted rent from occupant. If tenant wants a renewal lease, he must accept the renewal in his name only.
