Landlord Must Refund $46,000 Rent Overcharge

Rent-stabilized tenant complained of a rent overcharge. The DRA ruled for tenant and ordered landlord to refund $45,800, including interest and penalties. Landlord appealed, claiming that tenant had agreed to withdraw his overcharge claim in a separate housing court proceeding. The DHCR ruled against landlord. By the time landlord's PAR was decided, the housing court had vacated the settlement agreement. So landlord must refund the amount ordered by the DRA.
