Landlord Improperly Charged Renewal Lease Increases

Rent-stabilized tenant complained of a rent overcharge. Among other things, tenant claimed that landlord improperly charged renewal increases for renewals starting on March 1 in 2005, 2007, and 2008, even though landlord offered all three of these renewals on March 24, 2008. The DRA ruled for tenant and ordered landlord to refund $7,850, including triple damages. Landlord appealed and lost. Landlord submitted no documentation that the renewal lease offers were timely. Landlord also still had filed no annual rent registrations for 2009 and 2010 while its PAR was pending.
