The DOS inspector found nine garbage cans uncovered in front of the building, exposing household waste likely to spill onto the sidewalk. Landlord claimed that the cans were properly covered and said that the building super checked their condition at least four times a day, at 8 a.m., noon, 4 p.m., and 6 p.m. The ALJ ruled against landlord and fined it $100. Landlord appealed and lost. Landlord's sworn statement wasn't sufficient to rebut the findings of the DOS inspector.
