Landlord Fined for Ice on Sidewalk

DOS issued a violation notice to landlord on Jan. 27, 2014, for leaving an ice condition on the sidewalk in front of the building with no attempt to sand, salt, or shovel a path for pedestrians. Landlord claimed that she had salted the sidewalk on the evenings of Jan. 25, 26, and 27, but that it was so cold that the snow didn't melt. She claimed that she also tried to shovel the ice, but that it couldn't be moved. Landlord also claimed that by the time the violation was issued, the ice had melted. The ALJ ruled against landlord and fined her $100. Landlord appealed and lost.
