Landlord Fined $500 for Not Submitting BPD Test Report

DEP issued a violation notice to landlord for failing to submit an annual test report for the building’s backflow prevention device. Landlord claimed that it had now submitted the missing report. The ALJ fined landlord $500. Landlord appealed and lost. The annual test report wasn’t submitted before the violation date and a reduced penalty applied only if the report was submitted before the first scheduled hearing date. By the time landlord appeared before the ALJ, it was past that point.
