Landlord Entitled to Vacancy Increase When New Co-Tenant Moved In

A prior court order had granted landlord a vacancy increase in July 1978 because a new tenancy had been created when one roommate was substituted for another. The law at the time supported the court's decision. The DHCR ruled for landlord and added this increase back into tenant's rent. There was no overcharge.
