Landlord Didn't Wait Too Long to Start Case

Landlord sued to evict tenant for nonpayment of rent. Tenant claimed that landlord had waited too long to start the case for back rent owed. The court found that landlord didn't delay. Landlord had started a prior nonpayment case in 1993. The court dismissed that case for technical reasons in February 1994. Landlord was entitled to start a new case, and did so promptly in April 1994. The court awarded landlord a money judgment for the rent owed.
