Landlord Didn't Send Tenant Initial Registration

Landlord sued to evict rent-stabilized tenant for nonpayment of rent. Tenant claimed that he was being overcharged. The court ruled for tenant. Landlord had registered the apartment as rent-controlled in April 1984. At that time, the rent was $143.20. Landlord never sent tenant an initial apartment registration after the apartment was decontrolled, and tenant moved in. The court reduced tenant's current rent of $750 to $143.20, the last legal rent charged.

So, for the eight-month period that landlord claimed nonpayment of rent, tenant owed landlord nothing and landlord owed tenant over $5,000 in overcharges. The court ordered an additional hearing to decide if landlord should pay tenant triple damages for a willful rent overcharge.
