Landlord sued to evict tenant. Tenant claimed that landlord didn't serve a 15-day notice as required by section 2524.2 of the Rent Stabilization Code. The trial court ruled for tenant and dismissed landlord's petition. Landlord appealed, claiming that tenant wasn't rent-stabilized. The appeals court ruled against landlord. A prior court ruling had already determined that tenant was rent-stabilized.
