Landlord Didn't File Initial Test Report for BPD

DEP issued a violation notice to landlord for failing to install a backflow prevention device (BPD) at its building. Landlord claimed that a BPD had been installed and that its plumber should have mailed the initial test report to DEP. The ALJ ruled for landlord and dismissed the violation. DEP appealed and won. DEP again stated that it hadn’t received an initial test report prior to issuance of the violation. Landlord didn’t show that it mailed the BPD test report, only that its plumber should have done so. Landlord was fined $700.
