Landlord Didn't File for Increase

The DRA suspended fuel cost adjustments for landlord's building for 1991. The DRA found that landlord had previously obtained allowable fuel cost adjustments and didn't serve and file the required report of fuel cost decrease on time. Landlord appealed, claiming that the cost of gas actually increased in 1990. The DHCR ruled for landlord. Landlord submitted invoices proving that the price of gas in Brooklyn increased in 1990.
