Landlord Didn't Correct Enough Violations

The DRA denied landlord's application for maximum base rent (MBR) increases for 1990–91 based on landlord's failure to correct the required number of housing violations. Landlord appealed and lost. When landlord filed his MBR violation certification, there were no rent-impairing violations. But there were 17 other violations against the building as of Jan. 1, 1989. To qualify for the 1990–91 MBR increases, landlord should have corrected 80 percent of the violations, that is, 14 out of the 17.

At most, only seven of the 17 violations had been corrected by the violation certification deadline.
