Landlord Didn't Accept Ex-Spouse as Tenant

Landlord sued to evict apartment occupant after tenant moved out. The court ruled for landlord, and occupant appealed. Occupant never signed a lease with landlord. She had lived in the apartment with tenant while she was married to him. Then they got divorced, and tenant moved out. Landlord accepted a few rent checks from occupant, but this created only a month-to-month tenancy. Occupant was never a tenant and didn't become one under tenant's lease.
