Landlord Didn’t Clear Snow and Ice for 24 Hours

DOS issued a violation notice to landlord for failing to clear snow and ice in front of his building. Landlord argued that he couldn’t clear the snow because he was away on vacation. The ALJ fined landlord $100. Landlord appealed and lost. Although landlord’s neighbor eventually cleared the condition, the snow and ice remained on the sidewalk for at least 24 hours after the snowfall ended.

Although landlord’s neighbor eventually cleared the condition, the snow and ice remained on the sidewalk for at least 24 hours after the snowfall ended. Landlords must clear snow and ice within four hours after snow ends, not including the hours between 9 p.m. and 7 a.m. Being away is no excuse.
