Increase Reduced to Offset Prior Rent Hike

Landlord applied for MCI rent increases for, among other things, new windows. The DRA ruled for landlord, and rent-controlled tenant appealed. In 1978 landlord got a $9.25 rent increase for tenant's apartment for the installation of new storm and screen windows. Landlord pointed out that tenant's MCI increase wasn't just for new windows. The DHCR ruled for tenant. The useful life of the windows installed in 1978 hadn't expired, so tenant should get some offset. Landlord had also removed the storm windows to install the new windows.
