Landlord in Mount Vernon applied for MCI rent increases based on a number of improvements. The DRA disallowed any increase for roof work, and landlord appealed. Landlord's installation consisted of only a single ply of traditional asphalt-based materials. Under DHCR Policy Statement 91-2, this work didn't qualify as an MCI. But landlord's installation was done in 1984. At that time, a one-ply roof did qualify as an MCI. And Policy Statement 91-2 specifically stated that it didn't apply retroactively. The DHCR ruled for landlord and adjusted tenants' MCI rent increases.
