Hotel-Stabilized Tenant Not Entitled to Renewal Lease

SRO hotel tenant complained that landlord wouldn't give him a renewal lease. The DRA ruled against tenant. Tenant appealed and lost. In the appeal, tenant also claimed that landlord never gave him a first lease. The DHCR said landlord wasn't required to offer hotel-stabilized tenant a renewal lease. Tenant's complaint didn't state whether he had requested a vacancy lease from landlord. In any event, since an eviction proceeding was pending against tenant, landlord didn't have to give tenant a lease.
