Heat Condensate Pump, Water Meter Don't Qualify

Landlord applied for MCI rent hikes based on the installation of a heat condensate pump and water meter. The DRA ruled against landlord. Landlord appealed, arguing that these were structural improvements. The DHCR ruled against landlord. The heat condensate pump is connected with the heating system, but wasn't in itself an MCI. The water meter by itself also isn't an MCI. Neither of these items was installed in connection with and at the same time as any MCI such as a heating system or building-wide water distribution system.
