Handicap Ramp Qualifies as MCI

The DRA granted landlord's application for MCI rent hikes based on the installation of a handicap ramp and new lobby doors. Tenant appealed and lost. Tenant claimed that the work was done before 2007, when landlord claimed it was done. Tenant submitted a December 2006 letter from landlord's contractor describing the work as proof of this claim. But landlord submitted documentation, including invoices, canceled checks, and a contractor's certification, showing that the work was completed less than two years before landlord filed its MCI application. The work qualified for MCI rent hikes.
