Garage Roof Qualifies

Landlord applied for MCI rent hikes based on the installation of a garage roof. The DRA ruled against landlord. Landlord appealed and won. Replacement of a garage roof generally doesn't qualify as an MCI. But when a garage is attached to and forms an extension of a building and its preservation is needed to maintain the structural integrity of the building, the work qualifies as an MCI. Landlord showed that its garage was attached to the building and, so qualified as an MCI.
