Former SRO Building Substantially Rehabilitated

The DRA found that landlord's building had been substantially rehabilitated and was no longer rent stabilized. Tenants appealed, claiming that landlord merely did repair work. The DHCR ruled against tenants. The building had been an SRO with five residential units and one commercial unit. Landlord did sufficient work to qualify as a substantial rehabilitation.

The DHCR ruled against tenants. The building had been an SRO with five residential units and one commercial unit. Landlord did sufficient work to qualify as a substantial rehabilitation. Landlord installed a new heating system with new gas supply, new plumbing throughout, new windows, new rooms, new waste compactor, new interior stairways, new doors and frames for apartments, a new intercom system and building entrance, new mailboxes, and other items. The building was vacant before the conversion, and at least 75 percent of the building-wide and apartment systems were replaced.
