Floor Cracks Are Minor Condition

Rent-stabilized tenants complained of a reduction in services, claiming that the apartment floor creaked. They also complained that bathroom floor tiles didn’t match in size and color. The DRA ruled against tenants. They appealed and lost. These conditions were minor and didn’t affect the use and enjoyment of the apartment. Although the floor creaked when walked on, there were no other defects detected by the DHCR’s inspector.

The ceramic floor tiles near the bathroom sink were smaller and slightly different in shade than others, but the floor was even and didn’t pose a trip hazard.
