Filing of Late Registration Negates Overcharge

Mount Vernon tenant complained of a rent overcharge. The DRA ruled for tenant because landlord hadn't registered the apartment between 1984 and 1990. Landlord appealed, arguing that it had charged the legal rent, and had filed all the missing registration statements in March 1992. The DHCR ruled for landlord. Once landlord filed the missing registrations, the overcharge got cancelled, as long as landlord had charged the legal rent. Since tenant's rent was otherwise proper, the overcharge finding is revoked.
