Eviction Stayed Due to DSS Delay in Paying Rent

Landlord sued to evict tenant based on late payment of rent. Tenant had testified at an administrative hearing before landlord that he had been laid off and his brother was unemployed. He showed that he had been approved for public assistance. Since the papers tenant received didn't address rent arrears, the hearing officer mistakenly found that tenant's lease should be terminated. Two days later the outstanding arrears were paid, but landlord failed to adjust the rent. The court ruled for tenant and dismissed the case.
