Eviction Petition Dismissed Because Rent-Stabilized Apartment Wasn't Registered

LVT Number: #32968

Landlord sued to evict rent-stabilized tenant for nonpayment of rent. The court petition alleged that the premises had been duly registered with the DHCR and that the rent charged didn't exceed the registered lawful rent. The court granted tenant's request to dismiss the case because the building wasn't properly registered with the DHCR. The unit wasn't currently registered with the DHCR and hadn't been registered since 2019.

The court granted tenant's request to dismiss the case because the building wasn't properly registered with the DHCR. The unit wasn't currently registered with the DHCR and hadn't been registered since 2019. The rent demanded was more than the last registered rent, the registration contradicted statements in the court papers that the unit was duly registered, and landlord was in noncompliance with registration requirements for rent-stabilized apartments.
