DRA Miscalculated Comparable Rents

Tenant filed a fair market rent appeal prior to April 1, 1984. The DRA ruled for tenant, finding that the initial rent charged was slightly higher than the legal rent. Landlord appealed, claiming that there was a $10 error in the DRA's calculation of comparable rents, since electricity was included in rents at the building and this resulted in an additional guideline increase. The DHCR ruled for landlord. The first stabilized rent charged didn't exceed the fair market rent.
