DOB Special Inspection Cost Included in Rent Hike for Elevator Upgrade

Landlord applied for MCI rent hikes based on elevator upgrading, including reconstructed shaftway, architect fees for elevator replacement, and engineering services for elevator and shaftway. The DRA ruled for landlord in part but denied any increase for DOB permit/filing fees, consulting services, controlled special inspections, overhead and profit charges, and sales taxes. Landlord appealed and won, in part. Special inspection was required by law and by DOB.

This was necessary work performed in connection with a qualifying MCI, so the $44,664 cost of the special inspection would be added to the permitted MCI cost.
