DHCR Revokes Rent Reduction Order Issued for Unregulated Tenant

Tenant complained to the DHCR in 2016 of a reduction in services. The DRA ruled for tenant and reduced his rent. Landlord, a cooperative corporation, appealed and won. The building had been converted to a co-op while a prior rent-stabilized tenant lived in the apartment. But when that tenant moved out and the complaining tenant moved in, the apartment was no longer subject to rent stabilization. DHCR records also showed that the apartment had been registered as "exempt, NYC coop/condo" in 1995. Landlord also submitted proof of the building's co-op conversion.
