DHCR Mistakenly Recorded Registered Rent

Tenant complained of a rent overcharge. The DRA ruled for tenant, and landlord appealed. In 1989 tenant's initial rent was $865. The DHCR's rent registration records listed the 1988 registered rent as $468. Landlord pointed out to both the DRA and to the DHCR that there was a clerical error in the registration. The 1988 rent for tenant's apartment, 14J, was $715. The 1988 rent for apartment 15J was $468. The rent amounts for the two apartments were reversed, either in landlord's registration forms or in the DHCR's entering of data. The DHCR ruled for landlord. Date-stamped copies of landlord's 1988 rent registration forms showed that landlord correctly registered the apartment rents and that the DHCR had incorrectly recorded the amounts for tenant's apartment and apartment 15J.
